Subject: INFORMATION REGARDING
CONVERSION OF DEDICATED DISTRIBUTION SYSTEM (DDS) / DEDICATED SUB-STATIONS INTO
COMMON DISTRIBUTION SYSTEM (CDS) AND PLACEMENT OF ELECTRICAL APPARATUS ON
PRIVATE INDUSTRIAL PREMISES WITHOUT OWNER’S NOC
Dear
Members,
PHMA South Zone is currently pursuing a matter before the
National Electric Power Regulatory Authority (NEPRA) concerning the use of
privately owned industrial premises and sub-stations by KESC/K-Electric and the
subsequent conversion of dedicated facilities into common facilities.
Background / Preamble
As our members are aware, industrial consumers obtaining
electricity connections at 11 KV were required by KESC/K-Electric to construct
Dedicated Sub-Stations for their individual industrial requirements. These
sub-stations were constructed within the consumers' industrial premises, with
the consumers bearing or contributing towards the relevant installation costs.
PHMA's concern is that, subsequently, KESC/K-Electric converted
such consumer-constructed Dedicated Sub-Stations into Common Sub-Stations and
started utilizing the infrastructure and space for supplying/serving other
consumers, without obtaining the prior consent/NOC of the original sub-station
owner or the owner of the plot/property.
This matter is presently being taken up in
proceedings/hearing before NEPRA, where the issue of NOC/consent of the
original owner, DDS-to-CDS conversion and continued use of privately owned
premises for supplying other consumers is particularly relevant.
In order to properly place the facts and documentary evidence
before NEPRA, PHMA South Zone is compiling details of affected industrial
consumers.
INFORMATION
REQUIRED FROM MEMBERS
Members who
have such cases are requested to provide:
1.
Name of Company / Industrial Unit
2.
Location of the premises
3.
Approximate year of installation of the sub-station
4.
Capacity of the sub-station
5.
Whether the sub-station was originally constructed
specifically for the member's industrial unit.
6.
Whether the industrial consumer paid or contributed
towards the construction/installation cost.
7.
Copy of the original challan, payment receipt or
any other available proof, if available.
8.
Whether the Dedicated Sub-Station was subsequently converted
into a Common Sub-Station / CDS.
9.
Whether other consumers are currently being
supplied through the same sub-station.
SPECIAL
NOTE – NOC / WRITTEN CONSENT
Members are specifically requested to confirm whether
KESC/K-Electric ever obtained any NOC, written consent, undertaking or
agreement from the original owner before:
If any NOC/consent
was obtained, please provide a copy.
If NO
NOC/consent was ever obtained, please clearly mention:
“NO NOC /
WRITTEN CONSENT WAS OBTAINED FROM THE OWNER.”
The NOC/consent issue is a key aspect of PHMA's proceedings,
particularly in relation to whether the original owner consented to the
DDS-to-CDS conversion and subsequent supply of other consumers.
For old connections, particularly those established during
the 1980s, 1990s or around 1999, members are requested to provide a copy of the
original challan, payment receipt or any other available proof of payment
relating to the construction/installation of the Dedicated Sub-Station. Where
such original documents are no longer available due to the age of the
connection, members may provide any available information regarding the
original installation and cost at that time, along with any other supporting
information, if available.
Members are requested to submit the required details and
supporting documents to PHMA South Zone by 12th September 2026.
Your cooperation in providing this information is highly
appreciated and will assist PHMA in presenting the cases of affected members
before NEPRA.
